Read More on the Eye On the Amazon: http://amazonwatch.org/news/2014/0528-whos-bribin-who The only direct testimony supporting Chevron's key claim—i.e. that the Ecuadorian plaintiffs' legal team "bribed" the trial judge to allow them to write the opinion—comes from Guerra, the disgraced former Ecuadorian judge who is probably one of the most openly corrupt witnesses ever to blight an American courthouse. His entire testimony violated U.S. law, which prevents witnesses from being paid for their testimony. Key facts about Guerra: 1. He admits he accepted and paid bribes throughout his legal career, both as a practicing lawyer and as a sitting judge. 2. He was removed as a judge for misconduct. 3. In early 2012, he was nearly destitute and desperate to join his son and daughter living in the United States (his son illegally), but had no basis for immigration. 4. At that time, a high-profile news story broke about an Ecuadorian judge accepting a decision written by a party and given to him on a flash drive. Guerra approached Chevron seeking payment with exactly the same story: he claimed he had evidence that the plaintiffs wrote the judgment and gave it to the judge on a flash drive. 5. Chevron lawyer Andres Rivero and Chevron investigator Yohi Ackerman immediately paid him $18,000 in cash for his story, in violation of ethical rules against paying fact witnesses. Chevron later paid Guerra another $30,000 in cash. It then entered into an agreement to pay him $12,000 a month for at least two years and perhaps indefinitely. 6. Chevron operatives then bought Guerra a car, auto insurance, and health insurance. Company lawyers then moved Guerra, his wife, and his younger son and his son's entire family to the United States and hired lawyers to get them green cards. The incentives for Guerra to say anything to keep the money flowing are obvious. 7. Guerra could never produce the flash drive. His computers did not turn up even a single email from Pablo Fajardo, the lead lawyer for the affected communities in Ecuador, despite the fact Guerra had told Chevron Fajardo had sent him a flash drive with the judgment on it. And Guerra claims to have "lost" his calendar during the year that he said he was in a meeting with Mr. Donziger where discussion of the "bribe" took place. In any event, during the time of the claimed meeting, Mr. Donziger was not even in Ecuador because of an illness in his family, according to immigration records and undisputed testimony. 8. Guerra's testimony changed constantly depending on new evidence. Other documents he produced to substantiate his account appear blatantly forged. All the while, Chevron's high-priced attorneys from Gibson Dunn & Crutcher, led by Randy Mastro (who bills at $1,140 per hour), negotiated directly with Guerra in Chicago over his "price" while simultaneously preparing Guerra's sworn affidavit. The entire process is a violation of the ethical rules, as this affidavit by noted legal ethicist Erwin Chemerinsky attests. 9. In his decision, Judge Kaplan admitted Guerra was corrupt. Yet Judge Kaplan decided to credit Guerra's testimony anyway. Otherwise, there would be no high-profile "bribery" A grassroots campaign has already been launched by the Sierra Club and Amazon Watch asking members of the US Senate to investigate and put a stop to Chevron's abuse of the justice system, and vilification of the environmental and human rights community. Chevron's actions in this case and elsewhere set a dangerous precedent and represent a growing and serious threat to the ability of civil society to hold corporations accountable for their misdeeds around the world. Now a wide cross-section of U.S.-based environmental and corporate governance groups have condemned Chevron's most recent retaliatory attacks to intimidate the Ecuadorian indigenous peoples and farmers who have been harmed by the oil giant's massive contamination of their ancestral lands. This month, Governor Gavin Newsom’s administration reported a quarter of a million Californians experiencing homelessness requested help in 2020—numbers that skyrocketed from previous estimates in some Bay Area counties. The Golden State is lauded for its job opportunities and diverse population, but it’s also the state with some of the highest housing and transportation costs in the nation. Now, Californians are demanding change, and a cross-sectional group of affordable housing and homelessness advocates created Roadmap Home 2030, a definitive plan to end homelessness and create affordable homes for all over the next 10 years. Housing California, the California Housing Partnership, and dozens of experts and advocates identified 57 policy solutions to create affordable homes, protect low-income renters, end homelessness and ensure racial equity. With their detailed plan of creative solutions, coupled with dedicated leadership, this ambitious group believes a better California is doable. The wealth gap and a shortage of affordable homes in the state prohibits Californians from building healthy and fulfilling lives. On 8 April 2024, as part of WCEF Side Events 2024, CLG Europe’s Materials and Products Taskforce hosted a webinar titled ‘How the new EU institutions can kickstart the Circular Economy’. A recent report from the European Scientific Advisory Board on Climate Change (ESABCC) highlights that the EU has made very little progress in increasing the circular use of materials. ESABCC points out that the circular material use rate has been increasing very slowly in recent years; it went from 10.8% in 2010 to 11.7% in 2021. As mentioned in the report, the European Commission has announced its ambition to double the circular material use rate by 2030, but this would require a more than a tenfold increase in the recently observed average annual rate of change: from on average + 0.1 pp per year in 2017–2021 to on average + 1.3 pp per year in 2021–2030. According to the report, this would probably necessitate a combination of an increase in recycling and a decrease in the overall material demand. Leading up to the European elections, we anticipate a significant focus on circular economy in the coming five years. As a side event of the World Circular Economy Forum 2024 (WCEF 2024), this event delved into what role the circular economy should play in European politics and how the new institutions can promote greater circularity. The event convened a diverse array of speakers, encompassing scientific expertise, as well as perspectives from businesses and NGOs. This debate is ahead of the Taskforce for climate-neutral and circular materials and products (Materials and Products Taskforce) launching a report later in the year. This report will set the policy agenda for the EU's transition to circular economy, taking stock of the previous 5 years' progress and offering policy recommendations for the next 5 years. On 30 November 2022, The European Commission released its latest set of circular economy policies. This included key files such as the Packaging and Packaging Waste Regulation. The purpose of this event was to react to the release of these pieces of legislation and provide a space for key stakeholders to give initial responses to the new legislative initiatives, including policymakers, businesses and third sector organisations. The focus of this event was on the new policies and how they fit into the wider movement towards a more circular European economy. The event offered a collective space to discuss the policies whilst also giving a progressive business view. This event was hosted by CLG Europe’s Taskforce on Climate Neutral and Circular Materials and Products. The Taskforce was launched with the aim of driving forward policy action on sustainable materials by bringing together a group of progressive businesses across sectors and value chains. The group brings together companies that are actively committed to producing and using climate neutral and sustainable materials, and who want to work together to promote and support EU-wide measures to decarbonise material production and use. At COP27, the Taskforce launched its latest publication investigating the links between circular economy and climate We previously hosted a webinar following the March circular economy package. Following the release of the package, the Materials and Products Taskforce released its rapid reaction and more in-depth analysis. Since the release of the package, the Taskforce has been particularly focusing on the ESPR and has published a report exploring the benefits of digital products passports. We stand at a critical moment in history for food and farming. During the last century, our extractive farming practices have contributed to the depletion of nature and brought us to the brink of a planetary emergency, resulting in climate change, catastrophic biodiversity decline and a crisis for public health. With half of our land now used for agriculture, farmers across the globe have become the primary stewards of nature, climate and health. Yet their delivery of public goods requires redesigning our businesses and industries away from systems based on extraction and growth and towards approaches based on the principles of regeneration, sustainability and the circular economy. During this talk, Minette Batters explains how she is involved in the Global Farm Metric coalition and her vision for a sustainable farming future. Minette Batters is President of the National Farmers' Union and runs a tenanted family farm in Wiltshire. The mixed farming business includes a 100 cow continental cross suckler herd, and a small herd of pedigree Herefords as well as sheep and arable. Diversification includes the conversion of a 17th Century tithe barn into a wedding and corporate events venue, and horse liveries. Minette co-founded the campaigning initiatives 'Ladies in Beef' and the 'Great British Beef Week'. She has been an NFU member from grassroots through to County Chairman; she served as Wiltshire's Council delegate and also as Regional Board Chairman for the South West. Minette has also been a member of the NFU Governance Board and served as NFU Deputy President for four years from 2014 to 2018, before being elected as President in 2018.
