Read More on the Eye On the Amazon: http://amazonwatch.org/news/2014/0528-whos-bribin-who The only direct testimony supporting Chevron's key claim—i.e. that the Ecuadorian plaintiffs' legal team "bribed" the trial judge to allow them to write the opinion—comes from Guerra, the disgraced former Ecuadorian judge who is probably one of the most openly corrupt witnesses ever to blight an American courthouse. His entire testimony violated U.S. law, which prevents witnesses from being paid for their testimony. Key facts about Guerra: 1. He admits he accepted and paid bribes throughout his legal career, both as a practicing lawyer and as a sitting judge. 2. He was removed as a judge for misconduct. 3. In early 2012, he was nearly destitute and desperate to join his son and daughter living in the United States (his son illegally), but had no basis for immigration. 4. At that time, a high-profile news story broke about an Ecuadorian judge accepting a decision written by a party and given to him on a flash drive. Guerra approached Chevron seeking payment with exactly the same story: he claimed he had evidence that the plaintiffs wrote the judgment and gave it to the judge on a flash drive. 5. Chevron lawyer Andres Rivero and Chevron investigator Yohi Ackerman immediately paid him $18,000 in cash for his story, in violation of ethical rules against paying fact witnesses. Chevron later paid Guerra another $30,000 in cash. It then entered into an agreement to pay him $12,000 a month for at least two years and perhaps indefinitely. 6. Chevron operatives then bought Guerra a car, auto insurance, and health insurance. Company lawyers then moved Guerra, his wife, and his younger son and his son's entire family to the United States and hired lawyers to get them green cards. The incentives for Guerra to say anything to keep the money flowing are obvious. 7. Guerra could never produce the flash drive. His computers did not turn up even a single email from Pablo Fajardo, the lead lawyer for the affected communities in Ecuador, despite the fact Guerra had told Chevron Fajardo had sent him a flash drive with the judgment on it. And Guerra claims to have "lost" his calendar during the year that he said he was in a meeting with Mr. Donziger where discussion of the "bribe" took place. In any event, during the time of the claimed meeting, Mr. Donziger was not even in Ecuador because of an illness in his family, according to immigration records and undisputed testimony. 8. Guerra's testimony changed constantly depending on new evidence. Other documents he produced to substantiate his account appear blatantly forged. All the while, Chevron's high-priced attorneys from Gibson Dunn & Crutcher, led by Randy Mastro (who bills at $1,140 per hour), negotiated directly with Guerra in Chicago over his "price" while simultaneously preparing Guerra's sworn affidavit. The entire process is a violation of the ethical rules, as this affidavit by noted legal ethicist Erwin Chemerinsky attests. 9. In his decision, Judge Kaplan admitted Guerra was corrupt. Yet Judge Kaplan decided to credit Guerra's testimony anyway. Otherwise, there would be no high-profile "bribery" A grassroots campaign has already been launched by the Sierra Club and Amazon Watch asking members of the US Senate to investigate and put a stop to Chevron's abuse of the justice system, and vilification of the environmental and human rights community. Chevron's actions in this case and elsewhere set a dangerous precedent and represent a growing and serious threat to the ability of civil society to hold corporations accountable for their misdeeds around the world. Now a wide cross-section of U.S.-based environmental and corporate governance groups have condemned Chevron's most recent retaliatory attacks to intimidate the Ecuadorian indigenous peoples and farmers who have been harmed by the oil giant's massive contamination of their ancestral lands. In an increasingly urbanized and digitized world, many people live separated from nature. Today we’re discussing engaging with nature in the digital age. Melting glaciers and changing ecosystems provided some of the earliest signals that humans are changing our environment on a global scale, and at an unprecedented speed but in an increasingly urbanized and digitize world many people are separated from mother nature and they don't deeply understand how climate impacts them around them. And later in the show: Although many climate conversations talk about impacts on future generations, all too often those younger generations are not at the table or in the room. So how are young people taking charge of their climate future? For Isha Clarke, a high school student and activist from Oakland, California, by speaking truth to the senior U.S. Senator from her state. “I think that truth is respectful and that you can speak truth in a way that is compassionate and authentic,� says Clarke, who recently gained fame for a viral video in which she confronts Democratic Senator Dianne Feinstein over the Green New Deal. “I think the conversation now isn’t really about Senator Feinstein anymore,� Clarke says as she reflects on that experience and the ensuing coverage, “it's really about politicians in general and power holders in general, who aren’t and haven't been taking the necessary steps to reverse this climate crisis." In this electrifying talk, Kimberly Liang dives into the science behind lab-grown meat and calls for radical transformation to our food systems. On a global scale, cellular agriculture will allow us to dramatically reduce the effects of agriculture on climate change without forcing people to change their diets -- we can still have our steak and eat it too. Kimberly Liang is a young innovator who is radically transforming the agriculture industry with her unconventional ideas. She has built projects related to improving the taste and texture of cultured meat, and is currently performing scaffolding research that has the potential of reducing the need for livestock farming. Kimberly is an aspiring entrepreneur, who is interested in bringing her ideas into fruition through business ventures. She has developed strategies for UN Women to increase digital literacy in India, won national case competitions, and had her recommendations implemented by multiple multi-million dollar companies. She has spoken at multiple global stages about environmental sustainability and pleads the younger generation to take action on global issues. The younger generation is driving the climate change agenda. They are the voices that are capturing the attention of the media and the general public. The reasons for this are obvious. Anyone born in the past 20 years is likely to live all of their lives with climate change. They are in effect ‘GenClimate’. They clearly have the most to lose, but equally the most to gain if we manage to set a course for carbon neutrality. Angus Mackay is the Director of UNITAR’s Division for Planet with responsibility for aligning all the environmental activities of the Institute with Agenda 2030. Skills development is a strategic issue that underpins the effectiveness of all national policies, plans and programmes that aim to address pressing environmental challenges,including climate change, chemicals and waste management, biodiversity conservation and the transition towards circular economy. UNITAR undertakes skills assessments to help countries better understand their learning needs and develop national learning strategies supporting inclusive, safe and environmentally sustainable development. In the talk, Mohammed will be focusing on how necessary is it to re-frame the environmental education curriculum while also bringing up interesting topics such as lake studies, environmentally hazardous substances, and letting us humans reflect on who wants to be what in the future. He urges a change in the environmental education system, as we have no more spare time to consume the resources and produce carbon footprints as we did in the past. Life-long passionate teacher, educational administrator, molecular biology and conservation biology enthusiast. Growing up under the blue sky with six season in eastern India, Mohammed has found his love for nature since a very young age. Currently, Mohammed is living in UWC Changshu China and still continuing to enhance his knowledge on educational leadership, molecular and conservation biology. From talking about “galvanized slavery� to his recent research and study on the effects of education and the environment, Mohammed is keen on sharing to the younger generations on his thoughts on the effectiveness and importance of environmental education.
